Terms of Service

These Terms of Service govern your use of ouredja.com and any purchase you make from it. The site is operated by Oureja LLC, a limited liability company registered in the United States. By browsing this site or placing an order, you agree to these terms. Please read them carefully.

1. Definitions

“We”, “us” and “Oureja” mean Oureja LLC. “You” means the person browsing the site or placing an order. “Products” means the printed planners and any other goods offered for sale on this site. “Site” means ouredja.com.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, and able to form a binding contract in order to purchase from this site. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Products and descriptions

We describe our products as accurately as we can. Printed colours can vary slightly from what appears on your screen because of monitor calibration and the nature of printing on uncoated paper. Small variations in trim, binding alignment and paper shade are normal characteristics of print-on-demand manufacturing and are not defects. Page counts are approximate and stated as “450+ pages”.

4. Pricing and errors

All prices are shown in US dollars and exclude sales tax, which is calculated at checkout where applicable. We may change prices at any time, but a change never affects an order already accepted. If a product is listed at a materially incorrect price because of a technical or human error, we reserve the right to cancel the order and refund you in full rather than fulfil it at the erroneous price. We will always contact you first.

5. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not by itself constitute acceptance. The contract is formed when we release your order to production. We may decline or cancel an order where a product is unavailable, where we suspect fraud or an unauthorised payment method, where a shipping address cannot be served, or where a pricing error has occurred.

6. Payment

Payment is taken in full at the time of purchase through a secure, encrypted checkout. Card details are entered directly into our PCI-DSS certified payment processor and are never stored on our servers. You confirm that you are authorised to use the payment method you provide. There are no subscriptions, recurring charges, membership fees or charges added after purchase.

7. Print-to-order manufacturing

Each planner is manufactured individually after you order it. Once an order has entered production it cannot be cancelled or altered. This is the basis for the cancellation window described in our Refund & Returns Policy.

8. Shipping and delivery

Delivery timeframes, costs and destinations are set out on our Shipping & Delivery page, which forms part of these terms. All stated delivery dates are estimates and not guarantees. Risk of loss passes to you on delivery to the address you supplied.

9. Returns, replacements and refunds

Cancellations, replacements and refunds are governed by our Refund & Returns Policy, which forms part of these terms.

10. Intellectual property

All content on this site, including the planner’s interior design and page layouts, cover artwork, photographs, text, logos and the Oureja name, is owned by Oureja LLC or its licensors and is protected by copyright and trademark law. You may not reproduce, redistribute, resell, scan, photocopy or create derivative works from the planner or any site content without our prior written permission.

Your purchase grants you personal use of the physical book you bought. It does not transfer any intellectual property rights and does not permit commercial or classroom reproduction of its pages.

11. Acceptable use

You agree not to use this site to break the law, to attempt to gain unauthorised access to any part of it, to interfere with its operation, to scrape or harvest data by automated means, to introduce malicious code, or to place fraudulent orders.

12. Reviews and submissions

If you submit a review or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with our business. You confirm the content is your own, is accurate, and does not infringe anyone’s rights. We may remove content that is unlawful, abusive, misleading or off-topic.

13. Third-party links

This site may link to third-party websites. We do not control them and are not responsible for their content, products or privacy practices.

14. Disclaimer

Our planners are organisational tools. They are sold as-is for personal planning use, and we make no warranty that using one will produce any particular outcome. Except for warranties that cannot be excluded by law, the site and products are provided without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.

15. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any product or your use of this site is limited to the amount you actually paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or wedding-related costs. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.

16. Indemnity

You agree to indemnify and hold harmless Oureja LLC and its officers and employees against any claim arising from your breach of these terms or your misuse of the site.

17. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, strikes, carrier failures, utility or internet outages, or government action.

18. Governing law and venue

These terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-law rules. You and we agree that the state and federal courts located in Fayette County, Kentucky have exclusive jurisdiction over any dispute, subject to any non-waivable right you have to bring a claim in your local small claims court.

19. Severability and waiver

If any provision of these terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

20. Entire agreement

These terms, together with our Privacy Policy, Shipping & Delivery page and Refund & Returns Policy, form the entire agreement between you and us regarding your use of this site and supersede any prior understanding.

21. Changes to these terms

We may update these terms from time to time. The version in force when you place an order is the version that governs that order. The revision date below reflects the current version.
